The court has rejected the plea to lodge a case against 29 people, including the ousted OC Pradeep Kumar Das, in connection with the death of Abdus Sattar in an alleged ‘gunfight’ at Maheshkhali in Cox’s Bazar.

At the same time, the CID has been given the responsibility of investigating the case filed by the police, accusing anonymous, four years ago in the incident.

Maheshkhali Senior Judicial Magistrate Court Judge Abbas Uddin passed the order on Thursday afternoon.

Shahidul Islam, a lawyer for the plaintiff, said Abdus Sattar’s wife Hamida Akhter had filed a case against 29 people, including OC Pradeep and five policemen, for killing him in a gunfight. The case was heard on Wednesday.

The judge directed a CID officer who was not below ASP status to investigate the sensational murder case, he added.

Inability to take cognizance of the criminal petition, Judge Abbas Uddin of the Judicial Magistrate Court said, “There was a writ petition filed with the High Court on the matter.”

In the criminal petition filed by Hamida Akter, the accused are – Ferdous, chief of Ferdous Bahini, the then OC of Teknaf police Pradeep Kumar Das, SI Harunur Rashid, SI Imam Hossain, ASI Monirul Islam, ASI Shahedul Islam and ASI Azim Uddin.

Abdus Sattar, son of Nurucchafar of East Majherpara, was killed on February 14, 2017, at around 7.00 am with the help of Ferdous Bahini at the Lambasia area of Hoanok, said the plaintiff Hamida Akhter.

“The police station did not register the case in the incident, as a result, sought the High Court’s help. Based on Writ Petition No. 7793/17, the judge ordered to treat it as ‘Treat for Fire’. In the light of that order, she submitted a written petition to the SP of Cox’s Bazar on July 17 of the same year. But the police did not take cognizance of the petition,” she also said.

Police claimed that the deceased Abdus Sattar was an arms dealer. OC Pradeep Kumar Das refused to file a case with the police station at that time.
